This Legal Notice contains the general information applicable to access to and browsing of trakker.fit and Trakker's digital services. Registration, contracting and use of the Platform's features are also governed by the applicable Terms and Conditions.

Nature and purpose of Trakker

Trakker provides digital tools that enable independent professionals to manage their business and their relationships with clients, including, depending on the available features, planning, monitoring, communications, content, metrics and payments.

Trakker acts as a technology provider. It does not directly provide medical, healthcare, nutritional, physiotherapy, rehabilitation, physical readaptation, personal training or personalised professional advisory services. Professional services offered to clients are the responsibility of the professional providing them.

Access and use

Access to public information on the website is free of charge, without prejudice to services subject to registration, subscription or payment.

Anyone accessing the website or the Platform must use them lawfully and diligently. Unauthorised access to systems or accounts, the introduction of malicious code, alteration or interruption of the service, impersonation, and any use that infringes the law or third-party rights are prohibited.

The conditions applicable to accounts, features, user content, plans, payments, suspension and termination of the service are set out in the Terms and Conditions.

Intellectual and industrial property

Trakker or its licensors own the rights in the trademark, software, code, design, interface, documentation and proprietary content of the website and the Platform.

Their reproduction, distribution, communication to the public, transformation, extraction, reuse, reverse engineering or exploitation, in whole or in part, is not authorised unless prior written authorisation has been obtained or the law permits it. Rights in content provided by users are governed by the Terms and Conditions.

Third-party links and services

The website or the Platform may include links to or integrations with third-party services. Access to and use of those services are subject to their own terms and policies. Trakker does not control their content or availability and is not liable for events exclusively attributable to those third parties, without prejudice to any liability legally incumbent on Trakker.

Data protection and cookies

Information on the processing of personal data is provided in the Privacy Policy. Information on cookies and similar technologies, as well as the available configuration options, is provided in the Cookie Policy.

Prices and contracting

Where Trakker offers paid services, the price, applicable taxes and essential conditions will be displayed clearly before the contracting process is completed. The contractual relationship will be governed by the Terms and Conditions and by the information provided during the contracting process.

Governing law and jurisdiction

This Legal Notice is governed by Spanish law.

Disputes with professionals, businesses or self-employed persons will be submitted to the courts of Madrid, unless a mandatory rule provides for another venue. Where the user is a consumer, the courts determined by applicable law will have jurisdiction, and this Legal Notice will not limit the user's mandatory rights.

Where Regulation (EU) 2022/2065 applies, soporte@trakker.fit will be the single electronic point of contact for recipients of the service and for Member State authorities, the European Commission and the European Board for Digital Services. Communications are accepted in Spanish and English. The channel enables direct electronic communication and does not rely exclusively on automated tools.

Notices concerning allegedly illegal content must identify the content and its exact electronic location, explain the grounds for the notice, include the notifying person's name and email address where required, and contain a statement confirming the notifying person's good-faith belief in the accuracy and completeness of the information provided.
